In September 2022, Deputy Attorney General Lisa Monaco issued the so-called "Monaco Memo," revising the Department of Justice's (DOJ) corporate criminal enforcement policies across all DOJ divisions. This discussion will explore what impact the revised enforcement guidelines could have on the Antitrust Division's consideration of a company's compliance program at both the charging and sentencing stage in a criminal antitrust investigation. The panelists will also discuss how companies can strengthen their compliance programs to best position themselves to receive favorable consideration in the event of an investigation.
