Artificial Intelligence Under the Antitrust Radar

Lauren Briggerman will moderate the Women's Antitrust Forum panel discussion "Artificial Intelligence (AI) Under the Antitrust Radar" on October 7, 2024. As companies increasingly rely on artificial intelligence to collect market data and make business decisions, AI tools such as algorithmic pricing have drawn increased antitrust scrutiny. Private plaintiffs and federal and state enforcers have filed civil lawsuits alleging that companies are weaponizing AI tools, including the Department of Justice's (DOJ) recent action against RealPage. DOJ has also taken the position that price fixing and collusive conduct involving AI can be criminally prosecuted. Representing different vantages, Briggerman's panel will discuss the legal theories behind these lawsuits, whether they are likely to prevail in court civilly and criminally, and how companies can reduce the risk that they will face enforcement actions and litigation as AI becomes a common part of of daily business.
