Recent enforcement actions under the International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR) have continued to highlight the importance of companies correctly self-determining the export control jurisdiction and classification of their items. A single misclassification can quickly cascade into an overwhelming number of violations and other compliance headaches.
This webinar will discuss best practices and the key elements necessary to performing jurisdiction and classification assessments, as well as how to approach more difficult self-determination areas, including software, technical data, and services. It will also discuss official mechanisms for receiving determinations and resolving doubt, such as the ITAR's commodity jurisdiction procedure and other alternative mechanisms.
The speakers will also discuss the strategic and practical considerations that arise after a company has made a self-determination that is later scrutinized by a third party or by the government, such as when a company is directed to submit a commodity jurisdiction request. Notably, the last three ITAR consent agreements to focus primarily on misclassifications all originated based on those situations.
