Bradley Markano concentrates his practice on representing corporations and executives in complex civil litigation, white collar criminal defense, and investigations. He has particular experience in investigations and litigation arising from allegations of fraud against the government, including cases brought under the False Claims Act (FCA). Part of the firm's White Collar Defense and Complex Civil Litigation practices, Mr. Markano has handled all stages of multi-jurisdictional investigations and litigation, including pre-complaint investigations, motions practice, discovery, trial, and appeals, and has made appearances in state and federal courts nationwide.
Mr. Markano has an active pro bono practice and has represented clients in immigration and civil rights claims in both state and federal courts.
Prior to joining Miller & Chevalier, he was a litigation associate at a multinational law firm. He began his legal career as a law clerk to the Honorable John A. Kronstadt at the U.S. District Court for the Central District of California. While attending the New York University School of Law, Mr. Markano was Managing Editor of the New York University Law Review.
- Represented a government contractor in a qui tam action alleging small business subcontractor fraud arising from provision of linguists to U.S. Army in Iraq and Kuwait.
- Successfully represented a subsidiary of a Fortune 10 company in FCA litigation, resulting in the grant of summary judgment and the government's voluntary dismissal of all claims.
- Drafted a successful motion to dismiss FCA retaliation claims brought against a major pharmaceutical company in the Northern District of Ohio.
- Represented a national pharmaceutical manufacturer in an FCA case premised on alleged Anti-Kickback Statute violations and fraudulent inducement claims.
- Co-chaired a one-week jury trial in the District of Utah on behalf of plaintiffs asserting Fourth Amendment violations by federal law enforcement officers.
