Joanne Roskey, former Deputy Associate Solicitor at the U.S. Department of Labor (DOL) and former Chief of the Division of Health Investigations in DOL's Employee Benefits Security Administration (EBSA), was quoted on the potential revival of Trump-era policies related to short-term limited duration health insurance. The expectation is that the availability of these plans, which bypass certain Affordable Care Act (ACA) requirements, could increase under a new administration. Biden's rule, which shortened the duration of these plans from 36 months to three months (with a one-month extension), is currently being challenged in federal court in Texas. "This is something that's going to be resolved through the courts or through the new administration," Roskey said. She also highlighted the potential for renewed focus on the association health plan rule, a policy under Trump that Biden rescinded earlier this year. Roskey noted that there was significant interest in expanding options beyond ACA-compliant plans during Trump's last administration, which could lead to renewed attention in this area.
