In this article, Leah Moushey commented on the Department of the Treasury's Office of Foreign Assets Control (OFAC) decision to delist Tornado Cash, a crypto mixer, following the Fifth Circuit Court of Appeals ruling that OFAC lacked authority to sanction smart contracts tied to Tornado Cash. Following the delisting, OFAC filed a notice with the court arguing that the ongoing legal proceeding is now mooted. Moushey explained that the court may choose to reject OFAC's position that the matter is mooted because there's an open question as to whether Tornado Cash can be redesignated in the future. With respect to the impact of Tornado Cash's delisting on the criminal case against developer Roman Storm, Moushey stated that the judge ruled the case should move forward, acknowledging that the "scope of the alleged conduct went beyond the interactions with the smart contract."
