In this article, Lauren Briggerman, Amelia Hairston-Porter,* and Katherine Pappas discuss trends and noteworthy developments in recent Foreign Corrupt Practices Act (FCPA) and Cartel cases against corporate executives. The authors note an uptick of white collar cases going to trial, particularly in the cartel space where court showdowns are rare. This has resulted in some trial victories for the Department of Justice (DOJ), including in the tuna price-fixing and foreign currency manipulation cases. DOJ's trial attorneys have been active in FCPA cases, too, but with mixed trial results. The authors also touch on the new task force created by DOJ's Antitrust Division that is charged with ferreting out antitrust crimes in the government procurement process and recent charges against executives for other cartel-related crimes.
