In this article, Scott Flesch and Elissa Harwood provide their insights into the Armed Services Board of Contract Appeals (ASBCA) annual report for fiscal year 2024, comparing the report's statistics to previous fiscal years and discussing emerging trends in government contracts cases before the ASBCA. "The ASBCA provided relief to contractors appealing a contracting officer's decision in less than half of the cases decided on their merit in fiscal year 2024. This coincided with a substantial decrease in new cases filed, but an increase in the number of cases resolved. Interestingly, motions practice also decreased, as did the number of hearings held by the board," the authors wrote. "At the same time, the pursuit of ADR in cases notably increased, as did the pursuit of quicker resolution under the ASBCA's expedited and accelerated case proceedings."
