This month, Foreign Corrupt Practices Act (FCPA) enforcement authorities at the U.S. Department of Justice (DOJ) and U.S. Securities and Exchange Commission (SEC) published a Spanish-language version of A Resource Guide to the U.S. Foreign Corrupt Practice Act (FCPA Resource Guide). First published in 2012, the Guide is a critical reference source for FCPA compliance and enforcement matters. 

This development is yet another sign of the importance that U.S. regulators place on the reach of the FCPA in Latin America and the Spanish-speaking world. In 2022, more than half of FCPA resolutions involved questionable conduct in Latin America and approximately 70 percent of FCPA fines and penalties collected related to settlements involving misconduct in the region. Since 2021, the Biden administration has prioritized anti-corruption efforts in Latin America as part of its national security strategy. A Federal Bureau of Investigation (FBI) corruption squad based in Miami and dedicated to investigating corruption matters in Latin America has been highly active since 2019. 

The publication is no doubt welcomed news in Latin America. Miller & Chevalier's Latin America Corruption Survey, which has gauged viewpoints of Latin American business people and legal and compliance professionals since 2008, has identified growing awareness of the FCPA throughout the region over the last 15 years. Since the survey began in 2008, the percentage of respondents from local and regional companies who have some familiarity with the FCPA has grown to about 50 percent regionwide. Multinational company respondents from the region with familiarity has grown from three quarters of those surveyed in 2008 to almost nine out of every 10 surveyed in 2020. These trends show the notable impact that the FCPA is having on business in the region. 

Perhaps of most common use to the market, the FCPA Resource Guide provides specific guidance on what U.S. authorities see as the "hallmarks" of corporate anti-corruption compliance programs. Of particular interest to a Spanish-speaking audience, the Guide discusses international anti-corruption legal frameworks, the jurisdictional reach of the FCPA, the elements of an FCPA violation, commonly misunderstood components like facilitating payments, foreign government instrumentalities, and successor liability, and the FCPA's unique accounting provisions.

El Gobierno de los EE.UU. publica la Guía de Referencia sobre la FCPA en español

Este mes, las autoridades competentes de la Ley de Prácticas Corruptas en el Extranjero (FCPA) en el Departamento de Justicia (DOJ) y la Comisión de Valores y Bolsa de los Estados Unidos (SEC) publicaron una versión en español de la "Guía de referencia sobre la Ley de Prácticas Corruptas en el Extranjero de los EE.UU (FCPA)(Guía de Referencia de la FCPA). La Guía, publicada por primera vez en 2012, es una fuente de referencia fundamental para el cumplimiento y la aplicación de la FCPA.

Esta novedad es una señal más de la importancia que los reguladores estadounidenses ponen al alcance de la FCPA en América Latina y el mundo hispanohablante. En 2022, más de la mitad de las resoluciones de la FCPA involucraron conductas cuestionables en América Latina y alrededor del 70% de las multas y sanciones recaudadas por la FCPA se atribuyeron a acuerdos que implicaron mala conducta en la región. Desde 2021, la Administración Biden ha priorizado los esfuerzos anticorrupción en América Latina como parte de su estrategia de seguridad nacional. Un escuadrón de corrupción del Buró Federal de Investigaciones (FBI) con sede en Miami y dedicado a investigar asuntos de corrupción en América Latina ha estado muy activo desde 2019.

La publicación es sin duda una noticia bienvenida en América Latina. La Encuesta sobre Corrupción en América Latina de Miller & Chevalier, que ha medido los puntos de vista de los empresarios y profesionales legales y de compliance de América Latina desde 2008, ha identificado una creciente conciencia de la FCPA en toda la región en los últimos 15 años. Desde que comenzó la encuesta en 2008, el porcentaje de encuestados de empresas locales y regionales que tienen cierta familiaridad con la FCPA ha crecido en aproximadamente 50 por ciento en la región. Los encuestados de empresas multinacionales de la región con familiaridad han aumentado de tres cuartas partes de los encuestados en 2008 a casi nueve de cada 10 encuestados en 2020. Estas tendencias demuestran el notable impacto que la FCPA está teniendo en los negocios de la región.
